Informing us about the changes that were made to the Resolution of the CMU of March 20, 2022 No. 332, starting from Marc

As part of the "Legal Advice" project, the lawyer of our Foundation, Kristina Prykhodko, informs us about the changes that were made to the Resolution of the Cabinet of Ministers of Ukraine dated March 20, 2022 No. 332 "Some issues of payment of housing allowance to internally displaced persons" and are effective starting from 1 March 2024.

The specified changes establish new rules that grant the right to continue payments to IDPs. Such extension of payments will be possible in two ways:

the first - automatically without additional application;
the second - by personal application for continuation of payments for oneself or for the family.
For each of the specified methods of extension of payments, certain criteria are provided, which allow IDPs to continue receiving assistance.

The categories of IDPs who will be able to receive assistance without additional application include:

1) pensioners whose pension does not exceed UAH 9,444;
2) persons with disabilities of the I or II groups;
3) children with disabilities under the age of 18;
4) children suffering from such serious diseases as: perinatal damage to the nervous system, severe congenital malformations, rare orphan diseases, oncological, oncohematological diseases, cerebral palsy, severe mental disorders, type I diabetes (insulin-dependent), acute or chronic diseases kidney IV degree; children who have received a serious injury, need an organ transplant, need palliative care; children who have not been diagnosed with a disability, which is documented;
5) orphans and children deprived of parental care, persons under the age of 23, in particular those who are in family-type children's homes and foster families;
6) foster parents and adoptive parents.
Assistance to the above-mentioned IDPs should be extended automatically starting from March 1 of this year.

Let's move on to the criteria, the presence of which will allow continuation of payments for the family upon the corresponding application.

Therefore, IDPs who:

have moved (moved again) since January 1, 2022 from the territories of hostilities or temporary occupation;
the total income per family member during the three-month period (or one quarter) BEFORE the application for extension of payments is NOT greater than UAH 9,444/month;
meet the "property" criteria (that is, the rules on the purchase of cars, foreign currency, housing, deposits, etc. continue to apply).
Compliance with the above three conditions is mandatory.

If these conditions are met, then we proceed to the following mandatory criteria - the right to continue the assistance has:

A family consisting of an unemployed person who takes care of a child under the age of 14; a family in which 3 or more children under the age of 18 are being raised (all children must live in the family and not be raised in residential institutions) AND
the family actually lives in the territory of hostilities, OR
the family lives in a territory for which the date of the end of hostilities has been determined, or a territory that is not included in the list of territories, BUT there is no place in preschool education institutions and/or general secondary education institutions of this community or education is conducted online (fully or partially) .

A family consisting of:

an unemployed able-bodied person who has registered at the Employment Center as unemployed or as a job seeker, in particular to receive a training voucher, but has not yet been employed;
children who attend preschool education institutions and/or study in general secondary education institutions, and/or children who study in professional (vocational-technical), professional pre-higher and higher education institutions.
A family with a caregiver:

for a person with a disability of group I;
a child with a disability under the age of 18;
a person with a disability of group I or II due to a mental disorder;
a person who has reached the age of 80;
a child suffering from severe perinatal damage to the nervous system, severe congenital malformations, rare orphan diseases, oncological, oncohematological diseases, infantile cerebral palsy, severe mental disorders, diabetes mellitus type I (insulin-dependent), acute or chronic kidney diseases of the IV degree, who received a serious injury, in need of an organ transplant, in need of palliative care, who has not been diagnosed with a disability, which is documented.
The right to continuation of assistance is granted to a family consisting of able-bodied persons who work, carry out entrepreneurial activities / independent professional activities, in particular, who, during the previous six months of receiving assistance, were employed, registered as a self-employed person and started a corresponding activity or received assistance for gaining economic independence / micro-grant/ grant for creation or development of one's own business/ voucher for education, and the family includes children under the age of 14.

In this case, the aid is assigned to all persons from among the IDPs in such a family.

We draw your attention: if there are several unemployed able-bodied persons in the family, within two months from the date of granting assistance for the next six-month period, other unemployed able-bodied persons

no members of the family (except one beneficiary) are required to register at the Employment Center as unemployed or as jobseekers, in particular to receive a training voucher, or to start an activity.

If this condition is not met, payments will be stopped.

To continue payments, it is necessary to submit an application either in electronic form through the Diya application, or directly to the social protection body or the authorized person of the executive body of the village, settlement, city council, or TsNAP.
